Toyota Recall Accident Claims and Consumer Fraud Claims
Long before an accident involving a Toyota Lexus with a stuck accelerator pedal killed four people in 2009, and the subsequent Toyota recall, federal authorities were receiving complaints about unintended acceleration in Toyota vehicles that revved up to excessive speeds even after the driver’s foot was off the gas pedal. With more than 1,000 of acceleration incidents now on record, the Toyota recall lawyers at the Kahn Law Firm are now investigating cases of injuries involving accidents caused by defective Toyota vehicles.
Over the past few months, the defective Toyota lawyers at our firm have been monitoring the numerous unintended acceleration incidents involving Toyota vehicles, as well as the company’s response to them. Nothing about Toyota’s reactions to these accidents and injuries has inspired confidence. Toyota has recalled approximately 8.5 million vehicles from the American market, which is its largest recall to date. The Toyota recall is also one of the largest in US history.
Defective Toyota Vehicles Have Caused Accidents, injuries
Problems with defective Toyota vehicles are nothing new. The National Highway Traffic Safety Administration has been receiving complaints about Toyota vehicles accelerating to excessive speeds over at least the past five years. The agency even began an investigation into the problem, but failed to initiate a recall. In the absence of any federal action, millions of Americans continued to be placed in danger from using their defective Toyota cars and trucks.
There have been more than 1,000 incidents of unintended acceleration on record. So far, the National Highway Traffic Safety Administration has 51 reports of deaths involving unintended acceleration accidents in Toyota vehicles. This is not even counting the number of people who have been injured in these accidents.
It isn't just those Toyota owners who have been injured in accidents involving unintended acceleration, who have suffered tremendously. There are millions of Toyota owners in the country who now find that their vehicles sell for a much lower price on the market than they would have before the recall was announced.
Toyota owners in Texas and around the country have already begun to file Toyota consumer fraud claims for the lost resale value of these cars. These defective Toyota consumer fraud claims allege that Toyota knowingly concealed dangerous defects in its vehicles in order to protects its reputation, boost sales and ultimately become the world’s largest automaker. It was successful toward that end, as the automaker knocked General Motors off its long held position as the world’s largest automaker. As Toyota recall lawyers now find out, that race to the No. 1 position came at a price that consumers and motorists have paid.
Toyota has Failed to Explain Causes of Unintended Acceleration
As Toyota recall lawyers, we have waited for a satisfying explanation from the company for the unintended acceleration problem in its cars. To date, we have received no plausible explanation from the auto maker. Toyota first insisted that incompatible floor mats could cause the accelerator pedal to be depressed for longer than necessary, contributing to the acceleration. It then announced repairs of the gas pedal, including shortening the pedal to solve the problem.
The repairs that the company dealers have performed have also failed to tackle the problem. The NHTSA has continued to receive reports of acceleration in cars that have been supposedly fixed by dealers. This indicates that Toyota theories about the causes for the unintended acceleration continue to be way off base. A third, much more widespread line of thinking blames the acceleration on malfunction of wiring in electronics in Toyota vehicles.
The defective Toyota attorneys at the Kahn Law firm are monitoring developments in this crisis. We fully intend to hold Toyota accountable for the losses caused by these vehicles through a defective Toyota lawsuit. If you have been injured in an accident involving sudden and unintended acceleration in a defective Toyota vehicle, you may be eligible to file a Toyota recall lawsuit against the company, and recover damages for your injuries.
If you are a Toyota owner whose car has been included in the automaker’s recall list of vehicles linked to the unintended acceleration problem, you may also have a Toyota consumer fraud claim.
