Toyota Recall Lawsuits

As the extent of the unintended acceleration problem in defective Toyota cars and pickups has become clearer, more and more Toyota owners are coming forward to file defective Toyota lawsuits that address their financial and other losses. It is highly likely that these individual lawsuits will be merged into a single Toyota class-action lawsuit.

The first Toyota class-action lawsuit was filed in January this year. Toyota recall lawyers and judges will soon decide when and where these lawsuits are to be tried. This much is certain - the process of placing Toyota Motor Co. accountable for defective vehicles and the accidents and injuries caused to motorists, has well and truly begun.

There are three types of lawsuits that the Toyota lawyers at our firm are investigating:

Toyota personal injury lawsuits may be filed by a person or the family of a person who has been injured in an accident caused by unintended acceleration in defective Toyota vehicles. A typical Toyota injury lawsuit may include the following damages:

  • Medical expenses (these may include hospitalization costs, medication costs, doctor fees, ambulance costs, x-ray and diagnostic expenses, and related medical expenses)
  • Lost wages
  • Pain and suffering
  • Mental anguish
  • Loss of future earning potential
  • Disfigurement and disability

A Toyota wrongful death lawsuit may include the following damages:

  • Loss of economic support of the deceased
  • Funeral and burial expenses
  • Medical costs, if these were incurred before death

In both Toyota personal injury lawsuits and Toyota wrongful death lawsuits, there is a possibility that a jury may decide to award punitive damages. These damages are typically awarded in case a defendant has exhibited extremely negligent or callous behavior. Punitive damages are awarded not to compensate victims for their losses, but to punish the defendant, in this case Toyota, for its negligence. If a jury finds that Toyota was guilty of extreme negligence in concealing defects about its dangerous vehicles and failing to warn motorists of these, a punitive damages verdict may be likely.

Toyota consumer fraud claims involve loss of resale value that Toyota car and pickup owners have suffered because of the recent problems plaguing the company. Damages in these claims may be limited to the actual economic value lost by the owner of the car.

Our defective Toyota lawyers are investigating cases where injury or death has occurred in accidents caused by acceleration in these cars. If you or a loved one has been injured by a defective Toyota vehicle, contact a Toyota recall lawyer at our law firm for a free initial consultation.

The Toyota recall lawyers at our firm are also investigating consumer fraud claims and Toyota loss of resale value claims. If you're the owner of a Toyota vehicle included in the recent recalls, consult with a Toyota recall lawyer to discuss your case.
