GALVESTON - Harris County resident Edith Suarez is suing the city of Texas City over the drowning deaths of her husband and two children.
According to a lawsuit filed July 7 in Galveston County District Court, Hector Suarez and the unnamed twin girls died at the Texas City Dike last Oct. 3 because of the city's failure to place warning signs in the area.

May 23 (9:54 p.m.) A 39-year-old Friendswood man was charged with Driving While Intoxicated 3rd or more. Officers were responded to a disturbance at a residence in the 4400 block of Saffron Lane. The caller advised that the man, who they described as being drunk, mad and belligerent, had left. In his haste, he drove over a fence and other items in the yard. While officers were still investigating, the man returned. He failed a field sobriety test and refused a breath test. He was placed in the back of a patrol car and tried to kick out the window. While enroute to the jail, officers were told that this is the man's third DWI, making it a felony and permitting officers to have a mandatory blood draw performed. He threatened to resist the blood draw, but once at the hospital the blood draw was performed out incident.Read more...

"Loser Pays" In Texas: All Citizens Will Lose Precious Constitutional Rights
The House passed Governor Rick Perry's "loser pays" tort reform bill (H.B.274). On the surface, it sounds like a good idea. In reality, it is incredibly unreasonable and unfair. The bill is nicknamed "loser pays" because one of its many provisions would require, only in certain cases, that the loser of the lawsuit pay the winner's attorney's fees and other ligation costs. With this legislation, even a winning plaintiff may be assessed defendant fees if the plaintiff rejected a settlement offer higher than the jury's verdict. For example, if a plaintiff rejects a settlement offer and the jury verdict is less than 80 percent of the offer, the plaintiff would pay the defendant's attorney's fees from the time the offer was rejected. Once a defendant invokes the provision, fee-shifting also would apply to a defendant's rejection of a plaintiff counter-offer.Read more...

The owner of the Texas daycare center in which four children died in a fire has been placed on the 15 Most Wanted list.
As of Friday, Texas Daycare Center owner, Jessica Rene Tata (22) was added to the US Marshall's "Most Wanted" list with a $25,000 bounty on her head. On February 24, 2010, seven children were trapped inside a blazing daycare center (Jackie's Child Care) operated by Tata. The following day, investigators of the Houston fire department attempted twice to contact her regarding the fire at the in-home center. Tata refused to answer questions at first and then referred the investigators to an attorney. A US Marshals task force discovered that Tata had flown to Georgia on Sunday (February 27th). On April 18, 2009, Michael Patrick Jacobs Jr., 24, died after a Taser was held to him for 54 seconds by Fort Worth police officer. Jacobs, who suffers from schizophrenia, apparently stopped taking his medication, which caused him to become aggressive, prompting his parents to call police. When officers arrived, in an attempt to calm him down, he was warned that he would be Tasered.
