Amanda Knox Conviction Poses Questions for Texas Sexual Assault Lawyers

It was a trial far away from Texas that had sexual assault lawyers here and around the country transfixed, and then, stunned at what we believe, was an unfair verdict. Last week, an Italian court found 22-year-old American student Amanda Knox guilty last of the murder of her roommate Meredith Kercher. Prosecutors alleged that the murder was the result of a sexual assault.

According to Knox’s sexual assault defense lawyer, from the time she was taken into custody, the police and the media treated her like she was guilty. The police, according to her lawyer, acted more like prosecutors. Knox said that she felt pressured by Italian police, who struck her and abused her, calling her a “stupid liar.” At the time she was arrested, Knox spoke very little Italian. The translators who were assigned to her during her testimony to police, simply picked whatever they felt was worth translating, instead of interpreting what she said verbatim.

There has been flimsy, if any evidence, suggesting Knox murdered Kercher, and plenty of evidence showing she was not guilty of the crime.  However, the Italian justice system works very differently from the American one. The man who had earlier been convicted of Kercher’s murder, Rudy Guede, was allowed to make an impromptu statement in the courtroom, saying that he saw “the silhouette of Amanda” leaving Kercher’s room the night she was murdered.

We have full respect for the Italian legal system, even if we don’t understand how Knox was convicted and sentenced for 26 years in prison for Meredith Kercher’s murder, on barely any evidence.  To sexual assault lawyers in Texas, this seems to have been the case of a naïve American girl, who got in with the wrong crowd while in a foreign land. However, hanging out with the wrong crowd doesn’t automatically qualify you for a murder conviction and a 26-year prison sentence.  Fortunately in our country, the justice system really does hold a man innocent until proven guilty.

The Knox murder trial tragically illustrates the importance of getting yourself the right representation when you are accused of sexual crimes. Public perception in these crimes tends to weigh heavily against the accused, much before a trial even takes place.
